This marketing program is being run by State Bank of India (Bank) and SBI Card & Payment Services Private Ltd. (SBICPSL)
on www.flipkart.com, Flipkart Mobile App, Flipkart Lite Platform (all three collectively Platform), which Platform is owned and operated by Flipkart Internet Private Limited (Flipkart). It is open to all residents of India holding a valid and current SBI Debit or Credit Card (Cardholder) and to whom a communication is sent by Bank/ SBICPSL.

2. Offer is valid from 18th Dec 2016 (00:00 hrs) to 21st Dec 2016 (23:59 hrs) (Offer Period)

3. Under this Offer, State Bank Debit and Credit Cardholders will get an instant discount of 10% on the final net cart value (Offer) at the time of checkout during the Offer Period. 

4. Net cart value shall mean the net value of only the products (added to cart) which are eligible for the Offer
5. SBI Credit Cards shall mean credit cards issued by SBICPSL. SBI Debit Card refers to debit cards issued by the following banks:
   .   State Bank of India
   .   State Bank of Hyderabad
   .   State Bank of Bikaner and Jaipur
   .   State Bank of Travancore
   .   State Bank of Mysore
   .   State Bank of Patiala
6. The minimum cart value to avail the Offer is INR 5,999.00. The maximum discount that can be availed per card during Offer Period is INR 1500.00
7. The Offer is applicable on all products sold on the platform, except the following:

11.  In case a customer makes partial payments through Flipkart Gift Card/Wallet, the Offer will apply only on the net amount paid through SBI Credit Card. In such cases, amount paid through SBI Debit or Credit Card should be more than INR 5,999.00
12. The offer is also valid on 3, 6, 9 & 12 month EMI transactions on SBI Credit Card. As per the terms of the EMI facility provided by SBI Credit Card, 14% rate of interest applicable on monthly reducing balance for EMI transactions on SBI Credit Card
 

1. All Credit Cardholders, excluding SBI Corporate and Commercial Credit cards, with no payment outstanding for more
than 30 days and  are eligible for the Offer. This  Offer is not applicable to State Bank Virtual Debit Card

2. Offer is not applicable for Card-on-delivery transactions

3. Offer is not applicable on Gift Wrap or premium delivery charges

4. Delinquent and over-limit SBI credit card members will not qualify for this Offer. Bank and SBICPSL does not endorse
any of the products or brands being offered under the Offer and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products which shall be at the sole liability to the respective sellers of the products.

5.  All the existing offers, gifts, discounts etc. that are being offered can be availed by the Cardholders as part of this exclusive Offer as mentioned in the communication.

6.  In the event an Order is cancelled in part or full, the corresponding value will be deducted from the paid amount while checking eligibility of discount.

7.  Pictures of products shown in the communication sent to the customer either through mailers or advertised on the
Platform, are representative only and may not bear a resemblance to the actual products.  None of the parties shall under any circumstances be responsible towards the same.

8.  Products to which this Offer is applicable to are subject to availability from the respective sellers on the Platform and accordingly Bank, SBICPSL or Flipkart in no circumstances shall be liable for non-availability of any of the products.

9.  Under no circumstance will the discount being offered under this Offer be settled with cash in lieu by Bank, SBICPSL or
by Flipkart.

10. Bank and SBICPSL reserve the right to disqualify respective Cardholder(s) from the benefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card.

11. Bank and SBICPSL will not entertain any correspondence regarding the validity or acceptability of any additional
benefits offered by respective sellers on products/services made available by them and the same shall be at the sole risk and consequences of the concerned sellers and without reference to Bank and SBICPSL. 

12. All government Levies like Sales Tax, TDS, any Local Tax, Octroi etc., shall be payable by the Cardholder as applicable at the time the respective Offers were offered.

13. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be
promulgated anytime by any statutory authority. Any disputes arising out of the Offer shall be subject to arbitration by a sole arbitrator to be appointed by Bank (in case of SBI Debit Cardholders) SBICPSL (in case of SBI Credit Cardholders) for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be at New Delhi and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against Bank or SBICPSL.

14. Cardholders are not bound in any way to participate in the Offer. Any such participation is voluntary and the same is
being made purely on a best effort basis.

15.  Any query regarding the Offer will be entertained only till 30th Jan 2017. Post such date,  Bank, SBICPSL & Flipkart will not entertain any correspondence or communication regarding this offer from any persons.

16. Bank, SBICPSL and Flipkart reserve the right, at any time, without prior notice and without assigning any reason
whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether. The above Offer is by way of a special offer for SBI Debit and Credit Cardholders only and nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement and Convert2EMI terms and conditions. The terms of the above schemes shall be in addition to and not in derogation of the terms contained in the card member agreement.

17. Flipkart or the sellers shall not be liable for any failure by Bank and/ or SBICPSL to honor the transaction and for any technical issues as a result of which the transaction made by the Cardholder was not successful. Bank and SBICPSL shall indemnify and hold Flipkart and seller harmless against any claims by the Cardholder for unsuccessful completion of the transaction. Further, Banks/ SBICPSL shall solely be liable to the Cardholder for wrongful remittance of the amounts by it, without any reference to Flipkart.

18.The Cardholder [GE1] shall indemnify and hold Flipkart, Bank, SBICPSL and seller harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by such
sellers as a consequence of (i) violation of these terms and conditions, of the terms of user agreement, privacy policy (subject to change) as mentioned on the Platform; (ii) violation of applicable laws; and (iii) any action or inaction resulting in willful misconduct or negligence on the part of the customer.
19. This Offer is valid only in India. The minimum age of such Cardholder shall be 18 years.

20.  By participating in this Offer you agree to be bound by these terms and conditions of the Offer, standard terms and conditions, terms of use, privacy policy (subject to change) of the Platform and the terms and conditions of respective seller shall be applicable on the Cardholder.

21. Further, as required by applicable law, in the event that the Cardholder makes a purchase of an amount equal to or above Rs. 2,00,000, the Cardholder will be required to upload a scanned copy of his/her PAN card on the Platform, within 4 days of making the purchase, failing which, the purchase made by the Cardholder will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Cardholder, it need not be submitted again. The order of the Cardholder will be cancelled if there is a discrepancy between the name of the Cardholder and the name on the PAN Card.

22.
